{"id":50366,"date":"2025-03-25T12:16:11","date_gmt":"2025-03-25T11:16:11","guid":{"rendered":"https:\/\/torreviejaradio.com\/?p=50366"},"modified":"2025-03-25T12:16:11","modified_gmt":"2025-03-25T11:16:11","slug":"firmado-el-acuerdo-entre-la-generalitat-y-el-agente-urbanizador-del-plan-parcial-sector-29-la-cenuela-por-el-cual-la-generalitat-acata-la-reciente-sentencia-del-tsj-de-la-comunidad-valenciana-que-anu","status":"publish","type":"post","link":"https:\/\/torreviejaradio.com\/?p=50366","title":{"rendered":"FIRMADO EL ACUERDO ENTRE LA GENERALITAT Y EL AGENTE URBANIZADOR DEL PLAN PARCIAL SECTOR 29 LA CE\u00d1UELA, POR EL CUAL LA GENERALITAT ACATA LA RECIENTE SENTENCIA DEL TSJ DE LA COMUNIDAD VALENCIANA QUE ANULA LA INCLUSI\u00d3N DE ESTE SECTOR EN EL PATIVEL"},"content":{"rendered":"<p align=\"right\"><span style=\"color: #000000;\"><span style=\"font-family: Helvetica Neue;\"><span style=\"font-size: small;\"><span style=\"font-family: Montserrat Medium;\"><span style=\"font-size: large;\"><b>TORREVIEJA (25\/03\/2025).<\/b><\/span><\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">En la ma\u00f1ana de ayer lunes, 24 de marzo, tuvo lugar la visita a Torrevieja del Director General de Urbanismo, Paisaje y Evaluaci\u00f3n Ambiental, Miguel \u00c1ngel Ivorra, con el prop\u00f3sito de proceder a la firma acuerdo suscrito entre la Generalitat Valenciana y la mercantil Explotaciones Agr\u00edcolas la Ce\u00f1uela, S.L., en condici\u00f3n de agente urbanizador del Plan Parcial Sector 29 <\/span><\/span><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\"><i>La Ce\u00f1uela, <\/i><\/span><\/span><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">junto con el alcalde de Torrevieja, Eduardo Dol\u00f3n, por el cual la Generalitat procede a acatar la reciente sentencia 506\/2024, de 25 de julio de 2024, del Tribunal Superior de Justicia de la Comunidad Valenciana, que se anula la inclusi\u00f3n del sector antes referido en al \u00e1mbito del <\/span><\/span><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\"><i>Plan Territorial de la Infraestructura Verde del Litoral de la Comunitat Valenciana, <\/i><\/span><\/span><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">com\u00fanmente conocido por PATIVEL.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">En efecto, el Tribunal ha considerado en la sentencia citada que el suelo que qued\u00f3 afectado por el PATIVEL no cumpl\u00eda las caracter\u00edsticas necesarias que se precisaba para ser incluido como suelo no urbanizable del refuerzo del litoral -el denominado <\/span><\/span><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\"><i>SNUPL 2<\/i><\/span><\/span><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">, seg\u00fan la nomenclatura de dicha norma-; hecho este que afectaba a m\u00e1s de la mitad del sector que estaba en tramitaci\u00f3n, y que ya anteriormente hab\u00eda obtenido pronunciamientos favorables en materia de evaluaci\u00f3n ambiental.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">Cabe recordar que el plan parcial arranca desde la firma, en el a\u00f1o 2002, de un convenio entre el ayuntamiento y la propiedad, por el que \u00e9sta ced\u00eda gratuitamente el suelo necesario para la construcci\u00f3n del actual Hospital de Torrevieja y, a cambio, la administraci\u00f3n se compromet\u00eda a clasificar como suelo urbanizable el resto de la finca.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">Efectuada la cesi\u00f3n e iniciadas las obras del Hospital, comenz\u00f3 un largo procesos de tr\u00e1mites administrativos que iba a culminar con la aprobaci\u00f3n del sector, cuando, en 2018, se produjo la entrada en vigor del PATIVEL; norma territorial que excluy\u00f3 a m\u00e1s de la mitad de la finca del proceso urbanizador, obligando a la propiedad volver a tramitar el expediente urban\u00edstico, proceso que a d\u00eda de hoy no ha concluido.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">La propiedad, paralelamente a impulsar la aprobaci\u00f3n del sector solamente en la parte de la finca no afectada por el PATIVEL, recurri\u00f3 ante los tribunales dicha norma por entenderlo ilegal y causante de quebranto patrimonial para la mercantil titular de la finca.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">La reciente sentencia del TSJCV, de 25\/07\/2024, ha venido a darle la raz\u00f3n anulando el PATIVEL en lo que a la finca La Ce\u00f1uela se refiere. Ante el nuevo escenario planteado, y a fin de terminar el proceso judicial, las partes han suscrito un acuerdo de conformidad.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">El acuerdo firmado comporta la renuncia de la propiedad al ejercicio de reclamaciones por responsabilidad patrimonial; asumiendo Ayuntamiento y Generalitat la obligaci\u00f3n de acabar la tramitaci\u00f3n del actual plan parcial presentado por \u00e9sta y la de, llegado el momento, tramitar una eventual y futura ampliaci\u00f3n del resto de la finca que qued\u00f3 en su d\u00eda afectada por el PATIVEL.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">Con el acuerdo suscrito, la propiedad podr\u00e1 culminar el proceso de urbanizaci\u00f3n como estaba previsto desde 2002, y las administraciones firmantes eliminan el riesgo de asumir indemnizaciones como consecuencia de los cambios normativos que introdujo el PATIVEL.<\/span><\/span><\/p>\n<p lang=\"en-US\" align=\"justify\"><span style=\"font-family: Montserrat Medium;\"><span lang=\"es-ES\">Finalmente, cabe concluir que el acuerdo de la Generalitat entre Eduardo Dol\u00f3n, alcalde de Torrevieja, el Director General de Urbanismo, Miguel \u00c1ngel Ivorra, con la familia Carmona, propietaria de la finca \u201cLa Ce\u00f1uela\u201d, en el t\u00e9rmino municipal de Torrevieja, pone fin a m\u00e1s de veinte a\u00f1os de tr\u00e1mites y litigios para el desarrollo de dicha finca como suelo urbanizable residencial.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>TORREVIEJA (25\/03\/2025).
